我曾经说过,美国律师一百多万,比程序员还多,饭桶多去了。 这句话应该是我所有普法文字中最关键的一条。 不懂法律的人,对律师往往有着敬畏心理,觉得美国法律复杂,律师很神,遇到事情往往对律师言听计从---即使对方可能基本概念都搞不清。 其实,美国法律条款的理解就是一个英语阅读理解的问题,所谓 reading comprehension, 关键在于正确地、逻辑地理解相关条款。而阅读理解需要逻辑思维能力,能够正确的分析句子表达的各种条件、关系。 去年10月OJX报道桑兰主动撤诉,我就 立刻指出 【 官司已经打到这个程度,原告要全身而退,只能跟被告达成协议撤诉, 参见 FRCP 41(a)(1)(A)(ii) ,而不能无条件自主撤诉而保留再诉的权利 。】这个分析不是靠经验,而是单纯地解读相关的条款。 条款在哪?搜索“FRCP“。 而且相关条款是一个简单的英语句子,懂点英语稍微有点脑子就可以看明白。律师竟然未能正确理解,是可悲的。 法院 最近的裁决 与我三个月前的判断完全一致,还仔细解释了条款,可见法院的时间相当部分是被律师的初级错误浪费了。(当然,遇到复杂问题,法官也可能搞不清) 现在有遇到了一个问题,法庭因为桑兰没有出席录取证词按 FRCP 37(d) 要赔偿被告律师费。这次,我预先指出一下,这个律师费必须是“未能出席”造成的费用。参见 http://www.zhenzhubay.com/home.php?mod=spaceuid=2do=blogid=28147 。这个“未能出席”造成的费用,一般在几百到几千美金的量级*。 在桑兰中写过认罪书的海明又跳出来了,祝贺被告之余,建议被告尽快递交 RULE 11 动议。按海明的理解,如果案子结束 RULE 11 就不能递交了。这又是一个基本概念错误。即使案件已经结束,法院仍然可以根据 RULE 11 惩罚违反该条规则规定的诉讼方。但跟 RULE 37 不同,RULE 11相当于一个案中案,只能由 A3 法官裁定,相关裁决可以单独上诉。 * Attorney Mo will have a hard time coming up with a higher figure that can be proven to be causally connected to the Plaintiff's failure to attend the deposition. 想当年,中国沿海地带的劳工漂洋过海来到北美,充当苦力,吃尽了苦头,其中一个很大的原因就是文化水平低下,不懂英语,只能任洋人玩弄法律,任洋人宰割。 今天,来到北美的华人大多数是本科以上文凭或者相当于本科以上教育程度,英语基本不成问题。但对于某些智力水平低下加上中专估计都是开后门进去的来说,就够呛了。iMan 就是这样一例,英语水平可能比偷渡的船民还差,而且智商还特别低。这种人在北美社会混,估计只能给人擦皮鞋、扫厕所。当然这些工作也没有什么不可以,老老实实当良民也不会有人找他们麻烦。但 iMan 却喜欢在网上抄袭+撒谎冒充高明,有企图诈骗嫌疑,这就得注意了。 iMan 在微博中写道:【 对于联邦法庭民事诉讼,如果原告被告双方不在一个州,争议赔偿金额要在$75,000以上,法院才可受理。看联邦法 28 U.S. Code § 1332 - Diversity of citizenship; amount in... 如果你同事把你放在冰箱里的牛奶偷喝了一杯并偷吃了一块三明治。按美国法律,你能起诉他盗窃私人财产吗?前两天哪个白痴在这里说的我忘了ID了,偷一块面包也是盗窃!那偷一个三明治至少是抵三块面包啊。要判几年啊 】 28 U.S. Code § 1332 的链接在: http://www.law.cornell.edu/uscode/text/28/1332 , 其条款写道:【 The district courts shall have original jurisdiction of all civil actions where the matter in controversy exceeds the sum or value of $75,000, exclusive of interest and costs, and is between— (1) citizens of different States;...】 这句英文是啥子意思呢? 这就需要高一程度的英语水平了。简单的说,它说区法院 shall 具有对不同州的公民之间争议超过7万5钱的民事案件管辖权。英语稍微过关的人立刻知道,这是区法院具有管辖权的一种情况,但不是唯一情况。即使英语不行,但是如果有点脑子的也知道,这应该只是一种情况。 相关讨论参见本人2011年写的《 桑兰案被告说:联邦法院无管辖权 》。 对美国法律感兴趣、而且有一定英语程度的,我建议学习几个概念 1)The United States; 2) Laws of the United States; 3) Subject matter jurisdiction; 4) Federal question; 5) Strict Liability; 6) Statutory Damages.
刚看到iMan试图翻译《Scarborough Fair》,说是PK莲波,iMan翻译固然蹩脚、而且也没有读懂原诗,这倒在意料之中。但莲波是谁? 本以为是国内不懂英语的,结果一查发现此人【 早在ACT时代被文友誉为“六大家”(百合、莲波、散宜生、嚎、图雅、方舟子)...活跃于网络的时期大约是在1994年到1996年她留学美国芝加哥期间】。留学美国,英文程度似乎比方舟子还差啊。 先让我们看看 《Scarborough Fair》这首歌词。 Are you going to Scarborough Fair? Parsley, sage, rosemary and thyme. Remember me to one who lives there. She once was a true love of mine. Tell her to make me a cambric shirt. Parsley, sage, rosemary and thyme. Without no seams nor needle work. Then she will be a true love of mine. Tell her to find me an acre of land. Parsley, sage, rosemary and thyme. Between the salt water and the sea strand, Then she will be a true love of mine. 看下面的一段,【 Tell her to make me a cambric shirt. Without no seams nor needle work.】这是要她不用针线、无缝制作一件衣服,这在古代当然是不可能的。而只有完成这个之后,【 Then she will be a true love of mine.】,她才会再次成为我的所爱。类似的,下一段说让她在沙滩与海水之间找出一英亩地,她就会再次成为我的所爱。这也是讲一件不可能之事。这里面的"Then", 表达的是一个条件关系,后面的成为真爱必须是在前面的条件基础之上,而这个条件是一项不可能的任务。 因此,原歌词表达的是一种对旧爱的酸楚心态,并非简单的思念。而翻译者似乎完全没有理解这一点。其翻译是 【嘱彼佳人,备我衣缁; 勿用针砧,无隙无疵 伊人何在,慰我相思 嘱彼佳人,营我家室 良田所修,大海之坻 伊人应在,任我相视】 基本是牛头不对马嘴。比如说后面这句,译者理解成了找块海边地方造屋藏娇了,本来很动情的歌被翻得俗不可耐。 这让我想起中学时看过一本不知谁翻译的中文版《少年维特之烦恼》,通篇是充满了激情却毫无逻辑的句子,对照英译版发现通通翻错了。其中有一句我至今还有印象,译文中说某某先生是个农夫,实在不通,再一查,原来是说这个人是”cultivated"。如此水平居然堂而皇之印成了书! 回到这首诗,最难翻译的应该是“ Parsley, sage, rosemary and thyme.”这一句。我认为只能找中文中有类似含义的四种植物对应。
