刘强东可能被判处N 年有期徒刑

原来刘强东面临的刑事指控是强奸已遂 -- RAPE - COMPLETED。警方逮捕刘的依据是 “probable cause” -- 也就是足够的事实可信度。是根据事实依据警方的经验的逻辑推断。 probable cause 跟合理的怀疑（reasonable suspicion）不同，后者更多的是一种主观猜测。网上某些律师搞混这些基本概念，属于典型的7窍通了6窍。
刘强东涉嫌犯罪的相关刑法条款是：【A person who engages in sexual penetration with another person, .. is guilty of criminal sexual conduct in the first degree if any of the following circumstances exists: ... (c) circumstances existing at the time of the act cause the complainant to have a reasonable fear of imminent great bodily harm to the complainant or another;】
也就是说，控告者称遭到刘强东性穿刺，并且恐惧遭到立刻与巨大的身体伤害。
