美联邦法院依据排华法案认可川普禁令

我多次说过(但很多人不信),根据美国最高法院在19世纪的判决,排华法案(The Chinese Exclusion Act)是符合美国宪法精神的,这一判决从未被推翻,其法律精神至今仍然有效。美国国会后来废除排华法案并不意味着美国不能再次制订类似法案。

今天,波士顿联邦法院的一名法官就川普的所谓穆斯林禁令做出了裁决。这个案子的原告包括两名持美国绿卡的美国大学副教授以及两名在美国上学的 F-1 签证学生。就绿卡教授针对川普的诉讼,法官认为川普政府已经表明绿卡持有者不在其禁令限制的范围,他们的官司也就不必打了。法官裁决的重点是两名 F-1 学生签证的问题。

学生提出的一个论点是“平等保护” (EQUAL PROTECTION)。法官写道:

【The decision to prevent aliens from entering the country is a “fundamental sovereign attribute” realized through the legislative and executive branches that is “largely immune from judicial control.” Chi Thon Ngo v. I.N.S., 192 F.3d 390, 395 (3d Cir. 1999), amended (Dec. 30, 1999) (quoting Shaughnessy v. United States ex rel. Mezei, 345 U.S. 206, 210 (1953)). 】

美国法院的判决进行完全创新的情况极少,绝大部分必须依据已有的法律,包括成文法与判例法。这段法律论证依据的权威是 1953 年美国最高法院的 Shaughnessy  案例的第210页。顺着这个案例追索,我们可以查查 210页上援引的案子又是什么。我找出这个 1953 年美国最高法院判例 210 页相关原文如下:

【Courts have long recognized the power to expel or exclude aliens as a fundamental sovereign attribute exercised by the Government's political departments largely immune from judicial control. The Chinese Exclusion Case, 130 U. S. 581 (1889); Fong Yue Ting v. United States, 149 U. S. 698 (1893); Knauff v. Shaughnessy, 338 U. S. 537 (1950); Harisiades v. Shaughnessy, 342 U. S. 580 (1952). 】

上面的  The Chinese Exclusion Case, 130 U. S. 581 (1889) 就是 1889 年美国最高法院裁定排华法案没有违宪的判例。也就是说,美国最高法院 1953年的这个 Shaughnessy  判例是依据 1889 年排华法案的相关判例。

根据上述法律精神,这位美国法官认为针对川普禁令的诉讼没有成功的可能。因此,相关禁令的暂时中止被解除。川普赢得了一场法律上的初步胜利。下一步得看原告们是否会上诉了。
