margin: 0px; padding: 0px; font-size: 14px; font-weight: bold;"> 案件大事记</strong><br /><br /> 2011年10月5日<br /><br /> 两艘中国商贸船在湄公河“金三角”地区水域遭劫持，13名中国籍船员在湄公河泰国水域被枪杀。<br /><br /> 2012年4月25日<br /><br /> 糯康被抓获。在此之前，依莱于2011年12月13日被抓获，桑康在2012年4月21日被抓获。<br /><br /> 2012年5月10日<br /><br /> 糯康由老挝依法移交中方。<br /><br /> 2012年7月2日<br /><br /> 泰国向9名涉案军人发逮捕令。<br /><br /> 2012年9月<br /><br /> “10·5”案件中的6名犯罪嫌疑人被昆明市人民检察院依法提起公诉。<br /><br /> 2012年11月6日<br /><br /> “10·5”案件一审宣判。以故意杀人罪、运输毒品罪、绑架罪、劫持船只罪数罪并罚，判处被告人糯康、桑康、依莱死刑；以故意杀人罪、绑架罪、劫持船只罪数罪并罚，判处被告人扎西卡死刑；以故意杀人罪、绑架罪、劫持船只罪数罪并罚，判处被告人扎波死刑，缓期两年执行；以劫持船只罪判处被告人扎拖波有期徒刑8年；判决6被告人连带赔偿各附带民事诉讼原告人共计人民币600万元。根据每名原告人的不同情况，所得到的赔偿金额也不同，最高达到55万余元。<br /><br /> 2012年12月26日<br /><br /> “10·5”案件二审宣判，维持原判。<br /><br /> 2013年3月1日<br /><br /> 将对糯康等4人执行死刑。<br /><br /><strong style="border: 0px; margin: 0px; padding: 0px; font-size: 14px; font-weight: bold;"> 执行死刑毒枭得知将死血压高</strong><br /><br /> 据了解，在向糯康宣读死刑裁定后，糯康的表现还算平静，但他觉得做了赔偿又认罪，仍然希望获得宽大处理。<br /><br /> 据云南省公安厅监管总队副总队长、云南省看守所所长陆永昌介绍，在得知即将被执行死刑后，以前很平静的糯康也表现出了焦虑和紧张，不停地向管教民警提出要求，希望得到法律的宽恕。同时，糯康的血压升高。陆永昌表示，为防止糯康做出异常行为，已经将糯康单独关押和看管，民警进行近距离看管，也有相应的应急措施。另外3名罪犯也都表现得有些紧张。<br /><br /> 据糯康的一审辩护律师林丽介绍，在整个案件中，糯康的态度变化不断，比较矛盾。一审时，对案件有点回避，不管说什么，都比较绕，不肯认罪。后来，糯康又表达了歉意，觉得应该赔偿被害人。在拿出钱赔偿时，对于是不是应该赔偿，糯康又有点不明确。<br /><br /><strong style="border: 0px; margin: 0px; padding: 0px; font-size: 14px; font-weight: bold;"> 善后处理遗体火化家属领骨灰</strong><br /><br /> 昆明市中院表示，昆明是全国最早探索采取注射死刑的地方之一，这种方式更文明。对糯康等4人采取注射执行死刑，也凸显中国的司法文明。<br /><br /> 法院表示，在2月22日收到死刑复核裁定后，法官于2月24日向糯康等人进行了送达。当天，法院通知泰国、缅甸两国驻昆领事馆，对各罪犯进行会见，并通过领事馆联系各罪犯的近亲属，安排探视。<br /><br /> 法院征求了糯康等4人的意见，需不需要联系家人探视。4人均申请会见近亲属，法院方面就此通报了两国的领事馆。据法官介绍，糯康曾表示，希望见其10个子女，但记不清他们的联系方式，法院方面只能通报领事馆。<br /><br /> 死刑执行后将对遗体进行火化，然后再通知家属在固定时间内领取。如果仍无人领取，将会采取措施处理。<br /><br /> 截止到昨天，糯康还没有留下遗书。而桑康和依莱在会见家属后，已经向家属做了交代。<br /><br /><strong style="border: 0px; margin: 0px; padding: 0px; font-size: 14px; font-weight: bold;"> 其他罪犯泰不法军人本国受审</strong><br /><br /> 专案组负责人之一韩旭光表示，糯康等4人被执行死刑，该案算是画上了一个圆满的句号。韩旭光表示，专案组经过11个多月的艰难努力，第一次把外国人抓回来审判，并最终执行死刑，告慰了13名中国船员的亡灵，对他们的家属有了一个交代。<br /><br /> 韩旭光表示，此案中的另一名罪犯翁蔑目前仍在中国接受审讯。由于翁蔑是向缅甸方面自首，按照中缅两方的协议，翁蔑最终将交由缅方处理。<br /><br /> 而涉案的泰国不法军人，目前泰国警方仍在收集和固定证据。根据泰国的法律，军人是不能引渡到别国受审的。据泰国警方介绍，如果最终杀人罪名成立，这些不法军人也将面临重刑。<br /><br /><strong style="border: 0px; margin: 0px; padding: 0px; font-size: 14px; font-weight: bold;"> 查案内幕</strong><br /><br /><strong style="border: 0px; margin: 0px; padding: 0px; font-size: 14px; font-weight: bold;"> 用俩月确定糯康国籍</strong><br /><br /> 据了解，由于该案的特殊性，昆明检方提前介入，和警方一起工作，见证和规范警方的取证过程，确保证据能一步到位。同时，他们也见证了办案的种种困难。<br /><br /> 在枪支弹痕鉴别上，由于语言的差异、枪支的型号等有所出入，调取起来非常困难。因此，在办案时，不但要咨询中国的枪弹专家，还要由泰国的枪弹专家出庭作证。泰国方面开始只提供了一些材料，但这些材料无法作为证据。如泰国不法军人在岸边留下的痕迹和船上的弹壳，只有连起来才能形成证据链，经过反复的交涉，才取得完整的证据。<br /><br /> 在扎西卡是否应判死刑的问题上，警方和检方不但请法医专家、枪弹专家介入，还对船员的外貌特征和尸检报告进行细致研究，通过这些证据，证实扎西卡就是杀死中国船员黄勇的凶手。<br /><br /> 针对糯康本人，最重要的问题之一就是首先查其国籍，这件事同样遇到重重困难。糯康有老挝的临时身份证，又号称自己有几个国家的国籍。为此，专案组和检方一起前往缅甸取证，查明其国籍身份。在缅甸，身份查证不归警察部门而归户政，查询起来极其困难。最后，经过近两个月的努力，终于确定糯康的国籍身份，确定他是缅甸人。<br /><br /><strong style="border: 0px; margin: 0px; padding: 0px; font-size: 14px; font-weight: bold;"> 受害方对死刑判决表示满意</strong><br /><br /> 该案一审合议庭成员杨晓萍法官表示，在一审判决后，部分受害者家属对赔偿数额不太满意，也提起了附带民事的上诉，但二审法院维持了原判。目前，附带民事部分的判决已经生效，在此次死刑执行后将进行执行。<br /><br /> 何熙伦是受害船员何熙行的弟弟，也是“玉兴8号”的船主之一。据何熙伦的代理律师表示，在得知糯康将被执行死刑时，何熙伦等受害者家属对此表示满意。<br /><br /><strong style="border: 0px;
